Please ensure you bring your driver's license and boating license, if applicable, to the rental. Terms and Conditions

By booking your rental with St. Johns Jet Ski Rental, LLC, you are authorizing St. Johns Jet Ski Rental, LLC, to charge your credit card on file for any damages to the equipment, in addition to any applicable rental charges, booking fees, other taxes and fees, fuel surcharges, or other incidentals. In the event of damage, the credit card on file will be used to cover all damages to the equipment. If for any reason the card on file cannot be charged, you will be sued for any outstanding balance and related court costs. The Renter will be responsible for all other related costs, including but not limited to the actual or estimated costs of repair for physical damage to the equipment, cost of recovery to equipment/passengers, towing fees, staffing costs to trailer equipment to repair facility, and lost rentals. St. Johns Jet Ski Rental, LLC, will have the damage further assessed by authorized third party repair facility (within approximately two weeks from the time that the damaged rental is returned). Final costs associated with damage will be the sole responsibility of the renter.

The renter is responsible for any and all losses and damages to St. Johns Jet Ski Rental, LLC equipment while in their care, including but not limited to full cost of new replacement equipment, from causes including but not limited to trailering, launching, beaching or running aground, collision with other boaters or objects on or below the water, running engine or systems out of fluids or with low fluids causing premature wear to mechanical systems, weather loss, dockage, anchoring, or any other cause whether or not the renter is directly at fault. You will be held responsible for all damages. The Renter, operator, passenger, heirs or descendants of the previous, or anyone else involved in the rental agree not to sue St. Johns Jet Ski Rental, LLC, their representatives or their insurance company for any reason.

Renter agrees that he/she will disclose to St. Johns Jet Ski Rental, LLC all potential operators, passengers, and users of said rental equipment. Renter further agrees that in the event that he/she fails to notify St. Johns Jet Ski Rental, LLC of all potential operators, passengers, or users of said equipment, he/she will be personally liable for any damages to or caused by the undisclosed individuals, even if such damages arise out of the negligence of St. Johns Jet Ski Rental, LLC. St. Johns Jet Ski Rental, LLC does not recommend use of any PWC while pregnant, and will not be held liable for any health conditions aggravated by use of the PWC. St. Johns Jet Ski Rental, LLC reserves the right to cancel this agreement at any time for any reason.

Hold Harmless Agreement


This Hold Harmless Agreement ("Agreement") is made effective as of today’s date   _________________ (the "Effective Date"), by and between:


St. Johns Jet Ski Rental, LLC, (hereinafter referred to as the "Company"), and


[Customer's Full Name]   _____________________________________   , (hereinafter referred to as the "Customer").

WHEREAS, the Customer desires to rent a personal watercraft (PWC) from the Company, and


WHEREAS, the Company is willing to rent the PWC to the Customer, subject to certain terms and conditions, including the execution of this Agreement.


NOW, THEREFORE, in consideration of the mutual covenants contained herein and other valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows:


Rental of Personal Watercraft (PWC):

a. The Company agrees to rent a personal watercraft (PWC) to the Customer for the duration specified in the rental agreement. The effective date during the timeframe of   ____________   -   ____________.

b. The Customer acknowledges that they have inspected the PWC, bearing Florida vessel number ________________  , and found it to be in good working condition.

c. The Customer agrees to pay The Company   $ __________   for the PWC rental, not including taxes, fees, fuel charges, and any other unforeseen incidentals. 


Assumption of Risks:

a. The Customer and Passenger, if applicable, understand and acknowledge that operating a PWC involves inherent risks, including but not limited to personal injury, property damage, and death. The Company is not liable for property damage or any injury or death of the Customer, Passenger, any other person riding the PWC or any other person or property impacted due to the Customers actions while the customer has possession of the PWC. The Customer acknowledges they will be held personally liable for any damage done to any other person or property they cause while they are in possession of the PWC.

b. The Company is not liable for any injury or death of the Customer, Passenger or any other person riding the PWC resulting from aggressive wildlife or other acts of God.

c. The Customer voluntarily assumes all risks associated with the rental and use of the PWC, including risks arising from negligence or fault of the Company, its employees, or agents.

d. The Company will not be held liable for any personal items that are lost, damaged, destroyed or stolen during the rental period. 

e. It is recommended all occupants of the PWC wear appropriate swim attire and eye protection while the PWC is underway. 


Release and Hold Harmless:

a. The Customer hereby releases, discharges, and agrees to indemnify and hold harmless the Company, its owners, employees, agents, heirs, descendants and representatives from any and all claims, actions, liabilities, losses, damages, costs, or expenses arising out of or in connection with the rental and use of the PWC. The Customer agrees to reimburse the Company any attorney’s fees resulting from any legal action.

b. This release and hold harmless provision shall apply to claims based on negligence, strict liability, breach of contract, or any other theory of liability, whether known or unknown, arising out of or related to the rental and use of the PWC.


Boater's Safety Certificate and Driver's License:

a. If born on or after January 1st, 1988, the Customer must possess a valid Florida Boater's Safety Certificate and a valid driver's license while operating the PWC. If born prior to January 1st, 1988, the Customer must possess a valid driver’s license while operating the PWC. 

b. The Customer acknowledges that failure to possess the required documents may result in the cancellation of the rental agreement without a refund.

c. The Customer is responsible for knowing and abiding by all applicable laws, rules and regulations while operating the PWC.


Rental Terms and Conditions:

a. The Customer must be at least 21 years of age at the time the rental starts.

b. At the conclusion of the rental time, the Customer is no longer authorized to possess the PWC and shall return it to the original launch site.

c. There will be a $50 late fee for every 30 minutes past the end of the rental period, with a 15-minute grace period. 

d. If the Customer returns the PWC late, and there is another booking directly following the Customer’s booking, and the Company is forced to cancel that subsequent booking, the Customer will be held financially liable for the terms of that subsequent booking. 

e. The Customer will be financially responsible for any and all damage done to the PWC during the rental period, up to and including the cost of the PWC itself, and may be financially responsible for damage done to any other structure, dwelling, conveyance or vessel should there be a collision. The damage assessed will include parts and labor.

f. If the Customer damages the PWC to the extent it needs to be taken out of service to be repaired, the Customer will be financially responsible for the current 8-hour day rate, charged each day, until the Company is able to place the PWC back into service. 

g. There will be a $200 fine assessed should the Customer lose the PWC safety lanyard/ignition key.

h. Under no circumstances will the PWC be operated from dusk to dawn, including twilight hours.

i. The PWC is equipped with GPS monitoring. Any operators/occupants of the PWC consent to GPS tracking. 


Passenger Responsibilities:

a. The Company is not responsible for any injury or death of any passenger. The Customer is responsible for the safety of any passenger.

b. The maximum number of occupants allowed on the PWC at any time is two.

c. The Customer shall not allow the Passenger to operate the PWC without prior consent from the Company.

d. The minimum age for a passenger is 8 years old. The Customer is responsible for the passenger’s well-being at all times.

e. The total combined occupant weight shall not exceed 450 pounds.


Fuel and Gas Charges:

a. The PWC will be given to the Customer with a full fuel tank.

b. The Company will fill up the fuel tank at the conclusion of the rental period and charge the card on file for the customer.

c. The fuel charges will be based on current marina fuel rates.

d. Should the Customer operate the PWC to the extent the PWC runs low on fuel prior to the end of the rental period, it is the Customer’s responsibility to locate the nearest marina and fuel the PWC, at the Customer’s expense, in order to keep the PWC operational. Should the PWC be rendered inoperable due to low fuel level, the Customer will be responsible for any towing fees associated with transporting the PWC to the nearest fueling depot. 


Operating Requirements:

a. The Customer agrees not to operate the PWC in a reckless or negligent manner.

b. The Customer agrees not to possess or be under the influence of any drugs, narcotics, or alcohol of any kind while operating the PWC.

c. The Customer is solely responsible for any citations, fines, or legal fees issued by any law enforcement agency regarding the negligent operation of the PWC.

d. Should the PWC be impounded for any reason, the Customer will be responsible for all applicable towing, impounding and storage fees.

e. The Customer shall ensure the PWC is not operated in water less than 4 feet in depth. Doing so may cause debris to enter and damage the jet pump mechanism.


Life Jackets and Riding Area:

a. The Customer and any passenger must wear a US Coast Guard approved life jacket at all times while operating the PWC.

b. The Company will provide the Customer and passenger with life jackets as needed. It is the Customer’s responsibility to ensure life jackets are the proper size and fit for both the customer and passenger. 

c. The Customer will have the PWC lanyard/kill switch tethered to their life jacket at all times while operating the PWC.

d. Any lost or damaged life jackets will result in a $50 fine per life jacket.

e. If a child under the age of 18 will be the Passenger, the Customer will provide the Company notice of the child’s age and weight at least 24 hours prior to the start of the rental. This is to ensure the Company is able to provide the Passenger with the appropriately sized life jacket.

f. The authorized riding area will consist of the St. Johns River and any major lakes connecting to the river (excluding any shallow creeks). The boundary will be the DeLand Bridge (SR 44) to the north and the Douglas Stenstrom Bridge (SR 415) to the south.


Breakdowns and Negligence:

a. The Customer will be responsible for the cost of any towing or dredging required if the PWC breaks down due to customer negligence or runs aground due to customer negligence.

b. If a tow is needed, the Customer will ensure the PWC is not towed over 10mph. The Customer will be held liable for any damage done to the PWC due to it being towed faster than recommended. 


Insurance:

a. The Company holds general liability insurance in accordance with The Florida Fish and Wildlife Conservation Commission (FWC) livery regulations and Florida State Statute 327.54.

b. The Company does not provide insurance coverage for the Customer. The Customer acknowledges that they are responsible for obtaining adequate insurance coverage for their personal injury, property damage, and other liabilities arising out of or in connection with the rental and use of the PWC, if they choose to do so.

c. If the Customer chooses not to obtain their own insurance coverage, or does not provide proof of applicable insurance coverage, they will agree to and sign the following statement:

I understand that I do not have, or have not provided proof of, a vessel rental insurance policy for coverage of at least $500,000 per person and $1 million per event for any damage or injuries caused directly or indirectly by my operation of the vessel.

I understand that I may not have other insurance to cover any damage or injuries caused directly or indirectly by my operation of the vessel and that I will be personally liable for any such damage or injuries during the rental period.

Rental Refund Policy:

a. The Customer acknowledges that the rental fee is non-refundable, except in the case of inclement weather.

b. In the event of inclement weather preventing the rental, the Company will make reasonable efforts to reschedule the Customer within 14 days of the original rental date.

c. If the Company is unable to reschedule the Customer within the 14-day period, the Customer will be entitled to a full refund of the rental fee.

d. There is no early return refund, including an early return due to inclement weather. The Company reserves the right to rent out the equipment to an alternative renter if returned early, and is not obligated to refund or credit the original customer under these circumstances.


Governing Law and Jurisdiction:

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any legal action or proceeding arising out of or in connection with this Agreement shall be brought exclusively in the courts of Volusia County, Florida, and the parties consent to the personal jurisdiction of such courts.


Entire Agreement:

This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior negotiations, understandings, and agreements, whether oral or written, relating to such subject matter.
